The eleventh-century Indian Buddhist master Ratnākaraśānti presents a unique Yogācāra interpretation of tantric _maṇḍala_ visualisation in the _*Guhyasamājamaṇḍalavidhiṭīkā_. In this text, he employs the neither-one-nor-many argument to assert that the qualities of the mind represented by the deities in the _maṇḍala_ are neither the same nor different from the mind itself. He also provides five scenarios of meditation to explain the necessity of practising both the perfection method (_pāramitānaya_) and the mantra method (_mantranaya_) together in Mahāyāna. Ratnākaraśānti’s explanation exerts a (...) significant influence on the works of later Buddhist masters in India and Tibet, with parts of it being reused in the _*Śrīherukopadeśanāmasvādhiṣṭhānakrama_ by Śūnyasamādhivajra (c. the eleventh century), the eighteenth chapter of the _Āmnāyamañjarī_ by Abhayākaragupta (from the late eleventh to the twelfth century) and the tantric compendium _sNgags rim chen mo_ by the Tibetan master Tsong kha pa Blo bzang grags pa (1357–1419). This paper explores how Ratnākaraśānti’s explanation has been reused and modified in these subsequent works. While Śūnyasamādhivajra faithfully reproduced Ratnākaraśānti’s Yogācāra explanation, Abhayākaragupta modified it to align with his Madhyamaka view. Abhayākaragupta in turn influenced Tsong kha pa, who accepted Abhayākaragupta’s Madhyamaka modification in his works. This paper also engages with current scholarly discussions on textual reuse and the underlying reasons behind it. While Śūnyasamādhivajra and Abhayākaragupta assimilated Ratnākaraśānti’s explanation without acknowledgement, Tsong kha pa quoted the text by name and acknowledged Abhayākaragupta’s reuse of Ratnākaraśānti’s explanation. This paper concludes by discussing the factors that determine whether the reused text is acknowledged or not, and the possible reasons behind textual reuse. (shrink)

States all over the world have reacted to COVID-19 with quarantines of entire cities, provinces, and even nations. Previous studies and preliminary evidence from current lockdowns suggest that emergency measures protecting the public’s physical health by dislocating individuals, families, and social networks could well be causing a devastating public health crisis of mental ill-health in the months and years to come. This article is the first to take a public mental health ethics perspective in examining these lockdowns, the lodestar of (...) which is the right to mental health, rooted in the concept of human dignity. Even the strictest lockdowns are not necessarily unethical but are prone to damage mental health disproportionately, with vulnerable and disadvantaged populations being at particular risk. (shrink)

Access to legal information is fundamental to access to justice. Yet accessibility refers not only to making legal documents available to the public, but also rendering legal information comprehensible to them. A vexing problem in bringing legal information to the public is how to turn formal legal documents such as legislation and judgments, which are often highly technical, to easily navigable and comprehensible knowledge to those without legal education. In this study, we formulate a three-step approach for bringing legal knowledge (...) to laypersons, tackling the issues of navigability and comprehensibility. First, we translate selected sections of the law into snippets (called CLIC-pages), each being a small piece of article that focuses on explaining certain technical legal concept in layperson’s terms. Second, we construct a _Legal Question Bank_, which is a collection of legal questions whose answers can be found in the CLIC-pages. Third, we design an interactive _CLIC Recommender_. Given a user’s verbal description of a legal situation that requires a legal solution, CRec interprets the user’s input and shortlists questions from the question bank that are most likely relevant to the given legal situation and recommends their corresponding CLIC pages where relevant legal knowledge can be found. In this paper we focus on the technical aspects of creating an LQB. We show how large-scale pre-trained language models, such as GPT-3, can be used to generate legal questions. We compare machine-generated questions against human-composed questions and find that MGQs are more scalable, cost-effective, and more diversified, while HCQs are more precise. We also show a prototype of CRec and illustrate through an example how our 3-step approach effectively brings relevant legal knowledge to the public. (shrink)

Abstract“Psychological essentialism” refers to our tendency to view the natural world as emerging from the result of deep, hidden, and internal forces called “essences.” People tend to believe that genes underlie a person’s identity. People encounter information about genetics on a regular basis, as through media such as a New York Times piece “Infidelity Lurks in Your Genes” or a 23andMe commercial showing people acquiring new ethnic identities as the result of their genotyping. How do people make sense of new (...) scientific findings that are inherently complex if they don’t have years of specialized training and education at their disposal? Given the substantial overlap between a lay understanding of genetics and lay intuitions about essences, we argue that, when most people are thinking about genes, they are not really thinking about genes in the complex ways that good scientists are. Combating people’s essentialist biases can be a formidable challenge. Although we have identified some promising results of trying to reduce people’s genetic essentialist tendencies, there is still much to learn about how these essentialist biases can be countered. It is important to help people understand genetic information so they are able make well‐informed decisions about their lives. (shrink)

Introduction: Probationers, offenders with less serious and non-violent offences, and under statutory supervision, have low levels of self-esteem and physical health, and high level of family conflict, and poorer quality of family relationships. This study examined the effectiveness of the existing probation service and the additional use of a positive family holistic health intervention to enhance physical, psychological, and family well-being in probationers and relationships with probation officers.Methods: Probationers under the care of the Hong Kong Social Welfare Department were randomized (...) into a care-as-usual control group, a brief intervention group receiving two 1-h individual sessions [of a brief theory-based positive family holistic health intervention integrating Zero-time Exercise and positive psychology themes of “Praise and Gratitude” in the existing probation service], or a combined intervention group receiving BI and a 1-day group activity with family members. The outcomes were physical activity, fitness performance, self-esteem, happiness, anxiety and depression symptoms, life satisfaction, quality of life, family communication and well-being, and relationships with probation officers. Self-administered questionnaires and simple fitness tests were used at baseline, 1-month and 3-month follow-up. Linear mixed model analysis was used to compare difference in the changes of outcome variables among groups, adjusted of sex, age, and baseline values. Focus group interviews were conducted. Thematic content analysis was used.Results: 318 probationers were randomized into CAU, BI, or CI group. CAU showed enhanced physical activity, fitness performance and psychological health, and family communication with small effect sizes. BI and CI showed further improved physical activity, family communication and family well-being. Additionally, CI reported greater improvements in the relationships with probation officers than CAU with a small effect size. CI also reported greater increases in physical activity and family communication than BI with small to moderate effect sizes. Qualitative feedbacks corroborated the quantitative findings.Conclusion: Our trial provided the first evidence of the effectiveness of probation service and the additional use of an innovative, relatively low-cost, theory-based brief positive family holistic health intervention. This intervention may offer a new model for enhancing probation service.Trial Registration: The research protocol was registered at the National Institutes of Health. (shrink)

This paper aims to show that any account of how artworks lie must acknowledge (I) that artworks can lie at different levels of their content—what I call ‘surface’ and ‘deep’—and (II) that, for an artwork to lie at a given level, a norm of truthful communication such as Grice’s Maxim of Quality must apply to it. A corollary is that it’s harder than you might think for artworks to lie: Quality is not automatically ‘switched on’ during our engagement with art. (...) In a recent paper, James Edwin Mahon argues that literary artworks—novels in particular—never lie because they do not assert. In this discussion note, I reject Mahon’s conclusion that novels never lie. I argue that a central premiss in his argument—that novels do not contain assertions—is false. Mahon’s account underdetermines the content of literary works; novels have rich layers of content and can contain what I call ‘profound’ assertions, and ‘background’ assertions. Art viewers and critics talk as if visual artworks say things, express messages, or have meanings. For instance, Picasso’s 'Guernica' has been described as a “generic plea against the barbarity and terror of war”, forming a “powerful anti-war statement”. One way of understanding meaning in art is to draw analogies with language. My thesis explores how the notion of a speech act – an utterance with a performative aspect – can illuminate art’s power to ‘speak’. In recent years, philosophers of (...) art have explored speech act theory in relation to literary art, though barely at all in relation to visual art. Given the way we talk about painting, sculpture, installation, film, and photography, and given that artists have investigated performativity through their art, this neglect is surprising. My thesis develops two main arguments. First, artwork meaning is active. I argue that visual artworks, under certain conditions, are speech acts. They have propositional content, and they have a certain force: they can do things such as assert, protest, and criticise – things we would normally do with words. I defend these contested claims against several dissenters, and explore some consequences: in particular, I explore how art can lie, a hitherto neglected question. Second, artwork meaning is flexible. I argue that what an artwork says and does is affected by the context in which it’s displayed, and in particular, by its curation. As a result, an artwork’s content and force can vary from context to context. This goes against a dominant view in the philosophy of art – what I call ‘Originalism’ – that the meaning of an artwork is fixed by factors which held at the time of the work’s creation, and so cannot change across time. I argue that this is mistaken: artworks can change in meaning. Curatorial factors can affect an artwork’s content and force, and consequently its social effects. It is known that our verbal speech has the power to oppress and liberate people in a society. My thesis aims to show that art also has this power to shape society; through what it says, and through what it does. (shrink)

There is widespread and growing concern among U.S. consumers about the treatment of farmed animals, and consumers are consequently paying attention to food product labels that indicate humane production practices. However, labels vary in their standards for animal welfare, and prior research suggests that consumers are confused by welfare-related labels: many shoppers cannot differentiate between labels that indicate changes in the way animals are raised and those that do not. We administered a survey to 1,000 American grocery shoppers to better (...) understand the extent to which consumers purchase and pay more for food with certain labels based on an assumption of welfare improvement. Results showed that 86% of shoppers reported purchasing at least one product with the following labels in the last year: “cage or crate-free”, “free-range”, “pasture-raised”, “natural”, “organic”, “no hormone”, “no antibiotic”, “no rBST”, “humane”, “vegetarian-fed”, “grass-fed”, “farm-raised”. Of those who purchased one of the aforementioned labels, 89% did so because they thought the label indicated higher-welfare production practices, and 79% consciously paid more for the product with the label because they thought that the label indicated better-than-standard animal welfare. However, many of these labels lack uniform standards for the production practices they represent, and some labels represent production practices that do not influence animal welfare, thus the degree of the animal welfare impact of a given label is highly variable. These results indicate that labels need to clearly and accurately specify their animal welfare benefits to improve the consumers’ ability to purchase products that align with their expectations. Philosophical analysis of metaphor in the non-linguistic arts has been biased towards what I call the ‘aesthetic metaphor’: metaphors in non-linguistic art are normally understood as being completely formed by the work'sinternalcontent, that is, by its perceptual and aesthetic properties such as its images. I aim to unearth and analyse a neglected type of metaphor also used by the non-linguistic arts: the ‘artistic metaphor’, as I call it. An artistic metaphor is composed by an artwork's internal content, but also by (...) itsexternalcontent, which is provided by the work's artistic properties such as its history. The artistic metaphor has been gestured at but not afforded a considered analysis; I aim to do this. Identifying the artistic metaphor has at least two benefits. It shows how curation plays a role in generating metaphors in artworks, which has been overlooked, and it illuminates a potentially powerful tool to interpret and understand ‘conceptual’ art. Human action theory, with its emphasis on intentions and reasons, does little to enhance our understanding of the actions of nonhuman animals. Many animal (and human) actions are directed to objects in the world, including other animals. The notion of directedness can be analysed without attributing intentions or reasons to the agent. An action is directed to object X if and only if: (1) the agent singles out X, either by orientation or by selective performance of the action in the (...) presence of X; (2) the agent recognizes X as a suitable object; and (3) the goal of the action is that X should be in a certain relation to the agent or to some other object. The goal of an action is not necessarily attributable to the agent as the agent's goal in acting. Moreover, an agent can have a goal in acting without understanding how the action achieves the goal. The usefulness of the concept of directed action in the study of animal communication is illustrated with examples from the recent ethological literature. (shrink)

This article explores the intersections of power within transnational surrogacy in India, using the lens of geography to examine surrogate women’s and commissioning parents’ experiences and perceptions of space and mobility. The author analyzes ethnographic data within a geographical framework to examine how actors embody and experience power relations through space and movement, revealing how power is not simply about who moves and who doesn’t. Rather, in recognizing the specificity of the Indian context, and how different actors inhabit and move (...) through distinct spaces, a geographical lens reveals the shifting complexity of structures of agency and power. Drawing on extensive ethnographic fieldwork in India, the author traces how both surrogate mothers and commissioning parents experience moments of mobility and movement punctuated by intervals of immobility and stillness, in distinct ways that illuminate the power relations inherent in transnational reproduction. Functional questions about animal signals are intertwined with causal questions. This interrelationship is illustrated in regard to avian distraction displays. In purposive signalling, the sender has a goal of influencing the behavior of the receiver. Creativity is a critical 21st‑century skill, encompassing the ability to generate unique, diverse ideas (divergent thinking) and evaluate them to select optimal ones (convergent thinking). Despite attempts to integrate convergent thinking into creativity frameworks, most research focuses on divergent thinking, and studies assessing their association remain inconclusive. We examined the relationship between performance on two widely used measures of divergent and convergent thinking—the Alternate Uses task and the Remote Associations test—in UK adults. Alternate Uses scores of fluency, originality, elaboration, and (...) a composite score were all positively associated with Remote Associations test scores. We also replicated findings that Alternate Uses scores of fluency, originality, and elaboration were intercorrelated. This study reports a direct positive association between these measures, suggesting individuals who generate numerous unique, detailed ideas are also adept at identifying correct solutions. We discuss the implications and the need to integrate convergent thinking into creativity models. (shrink)

Abstract Daniel Dennett advocates the use of the intentional stance in adaptationist biology and in cognitive ethology. He sees intentional system theory as closely related to decision theory and game theory. In biological decision and game theory models, nature ?chooses? the strategy by which the animal chooses a course of action. The design of the animal imposes constraints on the model. For Dennett, by contrast, the description of nature's rationale imposes constraints on the design of the animal. Dennett's oversimplified conception (...) of nature's rationale undermines the usefulness of the intentional stance as a tool in cognitive ethology. Intentional system theory can be made more useful in investigating animal cognition by modifying its application to questions of biological function. (shrink)

Lewontin published an essay entitled “The Spandrels of San Marco and the Panglossian Paradigm: A Critique of the Adaptationist Programme.” The target of their critique is a style of thinking rooted in “the near omnipotence of natural selection in forging organic design and fashioning the best among possible worlds.” According to Gould and Lewontin, adaptationists assume that all traits of an organism are products of natural selection, and that the traits (...) were favored by natural selection because they were optimal solutions to problems posed by the environment. Gould and Lewontin called the adaptationist program the Panglossian paradigm because they saw strong parallels between the arguments of Dr. Pangloss in Voltaire’s Candide and the arguments of adaptationists and optimality theorists in biology. The purpose of this study is to examine the topic of older people in the world from the perspective of the Social Teaching of the Church. As explained in Christifideles Laici , the Catholic Church believes that the laity is summoned to pave the way for the arrival of God’s Kingdom, and people who are at an advanced age should still respond to God’s calling through their own unique way of contribution. In Familiaris Consortio it is emphasized that the Church (...) should help older people manifest their roles both in families and religious groups. Although it is mentioned in these two apostolic exhortations that older people are blessed with wisdom, it is not explained as they actually acquire such a blessing. In order to address this issue and elaborate on the meaning of older people’s wisdom, Grün’s theory on the nature of older people’s wisdom and where such a blessing comes from is made reference to in this study. Moreover, it is emphasized in the apostolic exhortation of Familiaris Consortio that older people are often marginalized in today’s industrialized and urbanized society and neglected in their families, while also enduring psychological and/or physical pain. Addressing this issue, the value of older people’s work and their unshirkable missions and duties are explained in the present study by examining the nature and value of man’s work as mentioned in Laborem Exercens . Sen’s “capability approach” is also utilized in the present study as a way to examine older people’s values and the deprivation of their capability, allowing an in-depth analysis of this topic. The findings of this study reveal that Grün’s theory of older people’s wisdom being shaped by their life-experiences is significantly complementary to the messages on older people in Christifideles Laici and Familiaris Consortio . While Sen’s capability approach does not offer a complete set of values or cultural system that solves this problem, the approach of “civilization of love” proposed in the Social Teaching of the Church is very useful in helping one contemplate on the problems faced by older people around the world. The parasite is widely conceived as a negative figure that takes without giving; perceived as an agent of corruption and destruction, it is subjected to programmes of eradication and expulsion across cultural, economic, political and ethical contexts. This paper offers an alternative approach to the status of parasitic relations in light of Michel Serres’s The Parasite, elaborated through ethnographic research into the after-hours culture and hidden economy of London’s Borough Market. We highlight the mutual dependence of agents in host-parasite networks (...) according to what we term ‘general parasitism’, while inquiring into its ethical potential. Ultimately, we argue that while taking into account the near ubiquity of parasitic relations cannot form the basis for any concrete axiomatic ethical paradigm, it should at least encourage an ethics of hesitation before judgement when faced with any apparent instance of parasitism: to presume that parasitism is undesirable and unethical is itself undesirable and unethical. In this study, we attempt to explain the divergent results found in the relationships between supervisor–subordinate guanxi and employee work outcomes. Specifically, we propose that the relationships between supervisor–subordinate guanxi and participatory management, turnover intentions, and organizational commitment are mediated by job satisfaction. Based on the data collected from a sample of 196 employees of three local manufacturing firms in Zhejiang Province, China, we found that job satisfaction fully mediated the effects of supervisor–subordinate guanxi on participatory management and intentions to (...) leave, but partially mediated the relationship between supervisor–subordinate guanxi and organizational commitment. There is no other published work in English devoted to analyzing the political and intellectual dimensions of black Cuban women’s thought across the island’s history. This text is essential reading for students of Afro-Latin American studies, Caribbean history, or courses focussing on black women in the Atlantic region.

This paper explores how consumers perceive retailer ethics. Based on a review of the marketing and consumer research literature, we conceptualize consumer perceptions of the ethics of retailers as a multidimensional construct and propose that its effects on consumer purchase behavior and word-of-mouth communication are more salient when consumers have strong rather than weak ethical beliefs. The model was validated using a random sample of 399 respondents in a collectivist society. The results of structural equation modeling confirmed that CPER is (...) a second-order construct comprising product fairness, price fairness, non-deception, fair trade, and green products. CPER positively predicted consumer purchase behavior and word-of-mouth communication. Moreover, ethical beliefs moderated the positive relationship between CPER and the word-of-mouth communication of consumers with strong ethical beliefs but did not moderate the relationship between CPER and purchase behavior. El estudio de aspectos generales referidos a la moral y a la ética permitió acceder a definiciones, bases legales y evolución histórica, a la vez que se profundiza en su repercusión en el sector salud y se desarrollan (...) las peculiaridades del trabajo anatomopatológico desde sus manifestaciones en la actividad asistencial, docente e investigativa. Se concluye que los principios éticos generales de la conducta profesional y médica son aplicables al trabajo anatomopatológico en todas sus esferas; al igual que los de la bioética. ABSTRACT The objective of the present study is directed to exhibit ethical peculiarities of the anatomical-pathological work in view of the historical-social reality. Theoretical and empirical methods are used and from the documentary analysis it occurs with modality in the contemporary approaches. The study of general aspects referred to the morality and to the ethics allowed to gain access to definitions, legal bases and historical evolution, simultaneously that deepens in its aftereffect in the sector health and the peculiarities of the anatomical-pathological work develop from its declarations in the welfare, teaching and investigative activity. One concludes that the general ethical beginning of the professional and medical conduct is applicable to the anatomical-pathological work in all its spheres; as those of the bioethics. (shrink)

The Medical Research Council National Survey of Health and Development (NSHD) is Britain’s longest-running birth cohort study. From their birth in 1946 until the present day, its research participants, or study members, have filled out questionnaires and completed cognitive or physical examinations every few years. Among other outcomes, the findings of these studies have framed how we understand health inequalities. Throughout the decades and multiple follow-up studies, each year the study members have received a birthday card from the survey staff. (...) Although the birthday cards were originally produced in 1962 as a method to record changes of address at a time when the adolescent study members were potentially leaving school and home, they have become more than that with time. The cards mark, and have helped create, an ongoing evolving relationship between the NSHD and the surveyed study members, eventually coming to represent a relationship between the study members themselves. This article uses the birthday cards alongside archival material from the NSHD and oral history interviews with survey staff to trace the history of the growing awareness of importance of emotion within British social science research communities over the course of the 20th and early 21st centuries. It documents changing attitudes to science’s dependence on research participants, their well-being, and the collaborative nature of scientific research. The article deploys an intertextual approach to reading these texts alongside an attention to emotional communities drawing on the work of Barbara Rosenwein. (shrink)

We’ve been led to believe that museums are temples of knowledge. The historical ideal of the European museum has been to improve us morally by educating us about the globe’s myriad different cultures, creative practices, and belief systems. We’re taught that museum spaces are neutral: that they represent the world from an ‘objective’ point of view. But we have been lied to.As art historian Alice Procter shows in this incisive book, Western museums fall devastatingly far from this ideal. They do (...) not merely represent the harms done by colonialist forces; they perpetuate them. Museums tell us stories about their objects on display—many stolen from their original homes—and push narratives which, often subtly, express harmful ideologies about cultures ‘discovered’ in the Age of Imperialism. As viewers, our perception is narrowed and moulded while the voices of the displayed marginalized identities are silenced.Procter takes us on one of her ‘Uncomfortable Art Tours’, guiding us through four types of museum, presenting a selection of objects ranging from a Gweagal Shield to art performances of human zoos, each with their own sobering story. Procter sensitively reveals the histories and meanings behind these pieces, which are often obscured or overlooked, to highlight the imperial and colonial reality of our art collections. Part 1 opens with the ‘Palace’; spaces which functioned as homages to a collector’s taste, often an aristocrat or royal, who displayed their private collections in an attempt to shape the taste of elite audiences. Part 2 takes us to the ‘Classroom’, a didactic space which sees the origin of categorization—taxonomy sinisterly extended to notions of race, pre-empting nineteenth-century eugenics. Part 3 presents the solemn ‘Memorial’ space, a site for remembrance and display of human remains. Ethics is the part of Practical Philosophy that deals with moral facts and philosophical problems that have their roots in human behavior. Bioethics is the branch of Ethics devoted to providing the principles for correct human behavior, with respect to life. Various procedures are used when treating patients with rheumatic diseases. New technologies have considerably improved their integral treatment; these scientific advances must be used with the main purpose of causing no harm and with prior informed consent. Therefore, it is necessary to argue on the bioethical implications that turn out from the use of scientific-technological advances in the treatment of patients with rheumatic diseases. (shrink)

Grounded in Mindfulness-to-Meaning Theory, this study examined the relation between dispositional mindfulness and life satisfaction through mediating mechanisms including savoring positive experiences and gratitude. A total of 133 Chinese mindfulness practitioners at 20–72 years old were recruited from a 3-day transnational meditation event in Hong Kong. Findings based on structural equation modeling indicated that controlling for sex, age, education, family income, number of hours of mindfulness practice per week, and type of administration, dispositional mindfulness was associated with satisfaction with life (...) through savoring positive experiences and gratitude as mediators. The findings provided initial evidence for these processes between mindfulness and life satisfaction in the Chinese context. To promote life satisfaction, researchers and mental health practitioners should recognize the chain of mechanisms related to mindfulness. (shrink)

The usage of scholarly journal articles in the academe is now gaining attention to cope with the ever dynamic and evolving teaching and learning processes. However, the use implies possible potential usage only because what is measured is the number of views and downloads of the articles. This paper explored how the teacher education faculty and students utilized scholarly journal articles in the teaching and learning of professional education courses. The study also determined the challenges in using these primary sources (...) and documented ways of overcoming them. Data were organized and analyzed using a thematic narrative technique of Riesman as the analytical framework. The inquiry was participated by six faculty and six students from the College of Education at a state university in Northern Mindanao in the first semester of the school year 2019-2020. The necessary protocol was followed, and ethical considerations were secured before the conduct of the study. An informed consent form was presented to each participant before they signed it, signifying that they are not forced to participate in the study. The faculty had a focus group discussion, while the students had a face-to-face interview with the researchers. Emerging themes revealed that scholarly journal articles were utilized by exposing learners to varied writings, enriching course content and learning, exposing them to process learning, preparing learners for classroom engagement, guiding learners to produce outputs, and allowing learners to acquire updates. The inquiry reported challenges in terms of the capability of the learners, interest and perception of learners, and the journal itself and its contents. Documented ways of overcoming these challenges include time management, frequency of use, selection criteria, and checking the author's background. (shrink)

A large number of cross-references to various bodies of text are used in legal texts, each serving a different purpose. It is often necessary for authorities and companies to look into certain types of these citations. Yet, there is a lack of automatic tools to aid in this process. Recently, citation graphs have been used to improve the intelligibility of complex rule frameworks. We propose an algorithm that builds the citation graph from a document and automatically labels each edge according (...) to its purpose. Our method uses the citing text only and thus works only on citations who’s purpose can be uniquely identified by their surrounding text. This framework is then applied to the US code. This paper includes defining and evaluating a standard gold set of labels that cover a vast majority of citation types which appear in the “US Code” but are still short enough for practical use. We also proposed a novel linear-chain conditional random field model that extracts the features required for labeling the citations from the surrounding text. We then analyzed the effectiveness of different clustering methods such as K-means and support vector machine to automatically label each citation with the corresponding label. Besides this, we talk about the practical difficulties of this task and give a comparison of human accuracy compared to our end-to-end algorithm. (shrink)

In this panel, we explore the future of value sensitive design (VSD). The stakes are high. Many in public and private sectors and in civil society are gradually realizing that taking our values seriously implies that we have to ensure that values effectively inform the design of technology which, in turn, shapes people’s lives. Value sensitive design offers a highly developed set of theory, tools, and methods to systematically do so.

Recent research observed a sensitive window, at about 14 years of age, in the acculturation rates of Chinese immigrants to Canada. Tapping an online sample ofusimmigrants, we tested these relationships in a broader population and explored connections with new potentially causally related variables: formal education, language ability and contact with heritage-culture and mainstream United States individuals, both now and at immigration. While we found that acculturation decreased with age at immigration and increased with years in theus, we did not observe (...) a similar sensitive window. We also present an exploratory path analysis, exposing the relationships in our sample between acculturation and the variables above. The novel relationships documented here can improve theorising about this rich and complex empirical phenomenon. (shrink)

As the USA contends with another surge in COVID-19 cases, hospitals may soon need to answer the unresolved question of who lives and dies when ventilator demand exceeds supply. Although most triage policies in the USA have seemingly converged on the use of clinical need and benefit as primary criteria for prioritisation, significant differences exist between institutions in how to assign priority to patients with identical medical prognoses: the so-called ‘tie-breaker’ situations. In particular, one’s status as a frontline healthcare worker (...) (HCW) has been a proposed criterion for prioritisation in the event of a tie. This article outlines two major grounds for reconsidering HCW prioritisation. The first recognises trust as an indispensable element of clinical care and mistrust as a hindrance to any public health strategy against the virus, thus raising concerns about the outward appearance of favouritism. The second considers the ways in which proponents of HCW prioritisation deviate from the very ‘ethics frameworks’ that often preface triage policies and serve to guide resource allocation—a rhetorical strategy that may undermine the very ethical foundations on which triage policies stand. By appealing to trust and consistency, we re-examine existing arguments in favour of HCW prioritisation and provide a more tenable justification for adjudicating on tie-breaker events during crisis standards of care. Because of the importance of Confucian doctrines in shaping ethical business practices under Chinese leadership, revealing the roles of other Chinese ethical doctrines in modern Chinese leadership is informative. A thorough understanding of the ethical foundations of Chinese leadership is necessary for fruitful interaction with Chinese leaders, according to cultural fit theory. The present study illustrates the philosophical foundations of business management, based on dialogues with five eminent corporate executive officers. It reveals that the CEOs practice a style of Chinese (...) leadership synthesizing Confucian, Daoist, Mohist, and Legalist doctrines. The Confucian doctrines advocate benevolence, harmony, learning, loyalty, righteousness, and humility. They are the most prevalent tenets that support paternalism and collectivism. The Daoist doctrines emphasize flexibility and reversion. They bolster the leader's forbearance. The Mohist doctrines underpin thrift and working with the masses whereas the Legalist doctrines inculcate self-control and innovativeness. Hence, contemporary Chinese leadership does not rely exclusively on Confucian ethics and this reflects evolution over 1000s of years. (shrink)

An intentional fallacy is committed when one sets the goal of getting to the author’s intention. In this paper, I restore authorial authority, through proposing a situational hermeneutic. It obligates, when engaging with a text, stepping into the author’s shoes. Instead of focusing only on the ideas of the author, I emphasise the importance of knowing how the text relates to the author’s world through identifying the referents. This priority of reference over meaning resonates with Chad Hansen’s black-box analogy in (...) contravention of Eurocentrism, which focuses on the mentality of the author. I develop an externalism from his apparent linguistic behaviourism, by bringing out the mental element, referential intention, in my pragmatic theory. I will argue for the importance of knowledge of situation of the author in doing hermeneutics, with the Daodejing as an example. (shrink)

First, I visit the Fogelin–Geach-dispute, criticizeMiller''s interpretation of the Geachian notationN(x:N(fx)) and conclude that Fogelin''s argumentagainst the expressive completeness of the Tractariansystem of logic is unacceptable and that the adoptionof the Geachian notation N(x:fx) would not violate TLP5.32. Second, I prove that a system of quantificationtheory with finite domains and with N as the solefundamental operation is expressively complete. Humanity obligates respect. To respect someone is to intend what the person intended that one intends. A daughter respected her father if if he intended that she rests regularly, then she does so with the correct motive. Jesus’ Greatest Commandment, through the Worship of Yahweh identified via the First Commandment, interacts love with respect. If to love is to value the loved one’s welfare, valuing it for its own sake differentiates a malignant form of love from one out of respect. (...) From gender, through ethnicity and humanity, I bring out the theological insight from us being created in the image of God. Why respect? Because we are human. But why does humanity obligate respect? Because Yahweh commanded so. The vice of idolatry, ecologically, is constituted by self-disrespect – a form of worship that demeans and defiles oneself. In eighteenth-century French natural history, the notion of preformation was not only a model for a small preexisting embryo that gradually extended its shape through the influx of particles, but also for an order that coordinated the dynamic relation between organic parts. Preformation depended therefore also on a hidden order behind the continuity of visible forms. Louis Bourguet, Charles Bonnet, and Georges Cuvier distinguished three organizational levels: First, the synchronic or functional order of organic systems; second, the diachronic order of (...) the initiation of mechanical processes; and third, the hierarchical order that regulates the interaction of organic parts. In this essay, I reconstruct and compare the three organizational levels in the writings of Bourguet, Bonnet and Cuvier, relate their models of organic unity to the principle of perfection, and contrast these models with Georges Buffon's critique of system theories. For Uexküll, biology is the science of the organization of living beings. In the context of Entwicklungsmechanik, he refers to Driesch’s and Spemann’s experiments on the development of embryonic germ cells to prove that self-differentiating processes constitute organisms as natural objects. Uexküll focuses on the theory of such self-differentiating processes or organizations. The notion of organization implies for him a “technique of nature” that is capable of structuring organic and inorganic material according to plans and rules.
